1. Scope
These Terms of Use apply to the use of the Artist Spotter platform (hereinafter "Platform"), operated by Kenny Kunze-Oehme and Julia Weiske, Wurzner Straße 9, 04315 Leipzig, Germany (hereinafter "we" or "us"). By registering an account or using the Platform, you accept these Terms as well as our Privacy Policy.
2. Description of Services
Artist Spotter is a platform that connects artists and collectives with bookers. We provide the technical infrastructure for profiles, booking requests, and contact between users. We are not a party to any bookings, performances, or other agreements made between artists/collectives and bookers via the Platform. We only facilitate the initial contact.
3. Registration and Account
Certain features require a user account. You are required to provide truthful information and keep your password confidential. An account is not transferable. You may delete your account at any time via your dashboard.
4. User Obligations
You may only upload content to which you hold the necessary rights — either because you created it yourself, or because you have been expressly permitted to use it (e.g., under a license). You agree not to upload or distribute content that

5. Anti-Discrimination and Awareness
Artist Spotter is committed to a discrimination-free and safe environment on the Platform. We do not tolerate degradation, harassment, or exclusion based on gender, gender identity, sexual orientation, origin, skin color, religion, or disability. In particular, we are committed to the visibility and equal participation of FLINTA* individuals (women, lesbian, intersex, non-binary, trans, and agender people) in the music and cultural industry. Violations of this principle can be reported via the "Report a Violation" form and may result in content removal or account suspension under §8.
6. Usage Rights to Content
You grant us a non-exclusive right, limited to the duration of your profile, to display your uploaded content on the Platform and to process it to the extent necessary for operating the Platform (e.g., resizing images). This also includes the cursory depiction of your profile in our own marketing and social media content promoting the platform (e.g., overview clips featuring multiple profiles). Your rights to the content remain unaffected.
7. Booking Facilitation and Limitation of Liability
We do not verify the accuracy of profile information, nor the creditworthiness, reliability, or qualifications of artists, collectives, or bookers. We accept no liability for the formation, performance, or any disputes arising from bookings facilitated through the Platform. Any payment processing takes place directly between the parties, not through the Platform.
8. Reporting and Moderation
Users can report content via the "Report a Violation" form. We review incoming reports and remove content that violates these Terms or applicable law, or suspend affected accounts. In making our decision, we consider the severity of the reported violation as well as any prior reports against the same account. Affected users are informed of a removal or suspension and the reasons for it, unless overriding interests prevent this.
Anyone who disagrees with a decision can informally submit an objection via email to info@artistspotter.com within 14 days; we will then review the decision again.
9. Handling Reported Copyright Infringements
If you believe that content available on the Platform infringes your copyright or related rights, you can report this via the "Report a Violation" form or by emailing info@artistspotter.com. Your report should include the affected content (URL), your right to it, and a way to contact you. After review, we will remove wrongfully published content or block access to it. In the case of repeated, substantiated reports against the same account, we reserve the right to permanently suspend that account.
10. Copyright
Content and works created by the site operators are subject to German copyright law. Reproduction, editing, distribution, and any form of use beyond the limits of copyright law require the prior written consent of the respective author or creator. For content uploaded by users, the usage rights granted under §6 apply; responsibility for the lawfulness of such content lies with the respective user.
11. Suspension and Termination
We may suspend or delete accounts in cases of serious or repeated violations of these Terms. You may terminate your account yourself at any time.
12. Liability
We are liable without limitation for intent and gross negligence, as well as for injury to life, body, or health. Beyond that, we are only liable for breach of material contractual obligations, and our liability is limited to the loss that was foreseeable and typical for this type of contract.
13. Changes to These Terms
We may amend these Terms with effect for the future, insofar as this is necessary for legal reasons or due to further development of the Platform. We will inform you of material changes in a timely manner in advance.
14. Final Provisions
German law applies. Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
